Custom Vehicle Rendering Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE "OFFICIAL RULES". VOID WHERE PROHIBITED.

1. Definitions

• Sponsor: Vierstra Design, the entity responsible for the overall administration and execution of the Sweepstakes, operated under ReplyFX LLC.
• Administrator: Vierstra Design, the entity responsible for overseeing the execution, administration, and judging of the Sweepstakes.
• Participant: An individual who meets the eligibility requirements and enters the Sweepstakes according to the Official Rules.
• Sweepstakes Entities: Includes the Sponsor, Administrator, ReplyFX LLC, their respective affiliates, subsidiaries, advertising/promotion agencies, and other individuals engaged in the development or execution of this Sweepstakes.

2. Sweepstakes Period

The "Custom Vehicle Rendering" Sweepstakes (the "Sweepstakes") begins at 12:01 AM Central Time ("CT") on August 1^st, 2024, and ends at 11:59 PM CT on September 30^th, 2024 (the "Sweepstakes Period"). The Sponsor's computer is the official clock for the Sweepstakes.

3. Eligibility

The Sweepstakes is open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are at least eighteen (18) years of age or older, nineteen (19) years of age or older for residents of Alabama and Nebraska, and twenty-one (21) years of age or older for residents of Mississippi, at the time of entry. Employees, officers, and directors of Vierstra Design (the “Sponsor”), their immediate family members (spouses, siblings, children, and parents, regardless of where they live), and members of the same households (whether related or not), and those of any of their respective parent companies, affiliates, subsidiaries, distributors, vendors, advertising/promotion agencies, and others engaged in the development, production, execution or distribution of the Sweepstakes, including but not limited to ReplyFX LLC (collectively referred to as “Sweepstakes Entities”), are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void in Puerto Rico, the U.S. Virgin Islands, Guam, U.S. military installations in foreign countries, and where prohibited or restricted by law.

4. Additional Verification

The potential winner is subject to verification by Sponsor or Administrator, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not a winner of any prize unless and until the entrant’s eligibility has been verified and entrant has been notified that verification is complete. Sponsor will not accept screenshots or other evidence of winning in lieu of its validation process. Any entry that occurs after the system has failed for any reason is deemed a defective entry and is void and will not be honored.

5. How to Enter

There are two (2) ways to enter the Sweepstakes:

1. Purchase Entries:

• Visit our website, Vierstra Design, and complete a purchase. For every $1 spent, you will receive one (1) entry into the Sweepstakes.
• Multipliers: During specified times, as announced on our website, multipliers will apply (e.g., 10x, 20x, 30x, 40x, 50x).

1. Mail-In Entries:

• To enter without making a purchase, handprint your first and last name, address, city, state, zip code, telephone number, email address, and date of birth on a 3" x 5" card using ink. Mail it in a standard business-size envelope with sufficient postage to: Custom Vehicle Rendering Sweepstakes, 801 E Douglas Ave, 2nd fl pmb#675 Wichita, KS 67202. Each mail-in entry will receive one hundred (100) entries. Limit one (1) mail-in entry per envelope.
• For multipliers, indicate the specific multiplier (e.g., "MULTIPLE-10X") on the bottom left-hand side of the envelope, postmarked during the announced multiplier period.
• Each mail-in entry must be mailed separately and be postmarked by the last day of the Sweepstakes Period and received within five (5) days thereafter.
• Mechanically reproduced or photocopied entries are not acceptable.
• There is a limit of fifty thousand (50,000) total entries per Participant regardless of method of entry during the Sweepstakes Period.

All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Internet entries must be made by the participant only at the aforementioned website(s) and application URL addresses. Entries made by any other individual or any entity and/or originating at any other website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. Sponsor reserves the right in its sole discretion to void any and all entries of an entrant who the Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes. Proof of entering information at the website is not considered proof of delivery to or receipt by Sponsor of such entry.

6. Winner Selection

The potential winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Period. The drawing will be conducted by a third-party app. The odds of winning depend on the number of eligible entries received.

7. Alternate Winner Selection

If the initial winner is disqualified, found to be ineligible, or fails to claim the prize within the specified time period, the Sponsor reserves the right to select an alternate winner from the remaining eligible entries. This process will continue until a winner is confirmed.

8. Winner Notification

The potential winner will be notified via telephone. The Sponsor will not notify winners via social media. The potential winner must respond within three (3) days of notification. If the potential winner cannot be contacted, fails to respond within the required time period, or the prize notification is returned as undeliverable, the potential winner forfeits the prize, and an alternate winner may be selected.

9. Prize

One (1) Grand Prize: A custom vehicle rendering valued at $2,000. The rendering will be a unique, high-quality digital image tailored to the winner's specifications and preferences. The rendering will also be printed on a t-shirt, valued at $42, which will be provided to the winner as part of the prize package. The total Approximate Retail Value ("ARV") of the prize is $2,042.

10. Prize Delivery

The custom vehicle rendering will be delivered to the winner as a high-resolution digital file, suitable for printing and other personal uses. Additionally, the rendering will be printed on a high-quality t-shirt, which will be shipped to the winner's provided address. Delivery of the digital file will be coordinated via email, and the physical t-shirt will be shipped via a reputable courier service.

11. Taxes

All federal, state, and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner. The winner may be required to complete and submit an IRS Form W-9 with his or her social security number or the equivalent for receipt of any prize valued at $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

12. Use of Personal Information

By entering the Sweepstakes, participants consent for the Sponsor to obtain, use, and transfer their name, address, and other information provided for the purpose of administering this Sweepstakes; the information provided in connection with the entry process will be used by Sponsor and Administrator only in accordance with Sponsor’s privacy policy. By participating in the Promotion and providing any contact information, participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy, available at https://store.vierstradesign.com/policies/privacy-policy .

Participants have the right to access, withdraw, and correct their personal data. Requests for such actions can be made by contacting the Sponsor at the address provided in the Sponsor section of these Official Rules.

13. General Conditions

By participating, entrants agree to release, discharge, and hold harmless the Sponsor, and its respective affiliates, subsidiaries, advertising/promotion agencies, and other individuals engaged in the development or execution of this Sweepstakes, from any liability, claims, losses, and damages arising out of or relating to their participation in this Sweepstakes or the acceptance, use, misuse, or possession of any prize received in this Sweepstakes.

The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the prize.

If for any reason this Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes. In such event, the Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment.

14. Publicity

Except where prohibited, participation in the Sweepstakes constitutes the winner's consent to the Sponsor’s and its agents' use of the winner's name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. This includes, but is not limited to, the right to use the winner's name and likeness in online announcements, social media posts, press releases, and other promotional materials related to the Sweepstakes. The winner further agrees to participate in any media or promotional activity related to the Sweepstakes as reasonably requested by Sponsor at no additional compensation beyond the prize awarded.

The winner may be asked to participate in interviews, photo sessions, and other promotional activities to publicize the win. The winner acknowledges that Sponsor may use such promotional materials in any manner they see fit, including in advertising and promotional campaigns. The winner agrees that any such materials become the property of Sponsor and may be used without further notice or compensation.

15. Limitation of Liability

The Sponsor is not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize.

16. Disputes

Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kansas.

17. Modification and Termination

The Sponsor reserves the right to terminate, modify, or suspend the Sweepstakes in whole or in part, at any time without notice and for any reason, including, but not limited to, if fraud, technical failures, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion. If the Sweepstakes is terminated before the designated end date, the Sponsor will (if possible) select the winner(s) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.

The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

18. Warranty Disclaimer

WITHOUT LIMITING THE FOREGOING, WITH THE EXCEPTION OF ANY WARRANTIES PROVIDED BY THE MANUFACTURER AND/OR THE DEALER, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE PRIZE AND THE WEBSITE, IS PROVIDED “AS IS” WITHOUT ANY WARRANTY BY SPONSOR OR ADMINISTRATOR OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WINNER ACKNOWLEDGES THAT SPONSOR AND ADMINISTRATOR HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO ANY COMPONENT OF THE PRIZE OFFERED IN THIS PROMOTION, INCLUDING BUT NOT LIMITED TO ITS QUALITY, MECHANICAL CONDITION, OR FITNESS FOR A PARTICULAR PURPOSE.

19. Sponsor

The Sponsor of the Sweepstakes is Vierstra Design, 801 E Douglas Ave, 2nd fl pmb#675 Wichita, KS 67202. The business is operated under ReplyFX LLC.

20. Administrator

The Administrator of the Sweepstakes is Vierstra Design, responsible for overseeing the execution, administration, and judging of the Sweepstakes. The Administrator ensures compliance with these Official Rules and applicable laws and regulations. The Administrator’s decisions are final and binding in all matters related to the Sweepstakes.

21. Winners List and Official Rules

To request confirmation of the name and city/state of residence for the prize winner, please send a self-addressed stamped business-size envelope by September 30, 2024, to: Custom Vehicle Rendering Sweepstakes Winners List, 801 E Douglas Ave, 2nd fl pmb#675 Wichita, KS 67202. For a copy of these Official Rules, send a request specifying Official Rules along with a self-addressed stamped envelope postmarked by September 20th, 2024, and received by September 25th, 2024, to the same address.
